Terms of Service

Residential & Commercial Holiday Lighting

Welcome to Deck The House Lighting! We specialize in professional holiday lighting design, installation, maintenance, removal, and storage. Our goal is to provide a beautiful, worry-free holiday experience through quality products, dependable service, and professional workmanship.

By accepting a proposal and agreeing to these Terms of Service, customers acknowledge and accept the following conditions.

1. Scope of Services

Deck The House Lighting provides residential and commercial holiday lighting services, which may include:

  • Custom holiday lighting design

  • Commercial-grade LED lighting and decorative materials

  • Professional installation

  • In-season maintenance

  • Seasonal removal

  • Storage of holiday lighting materials

The specific services, products, pricing, and scheduling arrangements will be outlined in each customer's approved proposal.

2. Lighting Ownership Options

Deck The House Lighting offers two service options.

Option A — Seasonal Lighting Lease

Under the seasonal leasing option, Deck The House Lighting supplies the lighting materials and decorations for the duration of the contracted holiday season.

All supplied equipment, including bulbs, wiring, clips, timers, wreaths, garland, and other decorations, remains the exclusive property of Deck The House Lighting.

The seasonal service includes installation, routine in-season maintenance, removal, and storage unless otherwise specified in the proposal.

Customers may not sell, relocate, alter, remove, or dispose of leased equipment without written authorization.

The lease does not transfer ownership of materials to the customer.

Option B — Customer-Owned Lighting

Under the customer-ownership option, customers purchase designated commercial-grade holiday lighting products directly from Deck The House Lighting.

Ownership of purchased equipment transfers to the customer upon full payment, subject to the terms of the accepted proposal.

Installation, maintenance, removal, and storage services are provided as specified in the proposal.

Customer-owned equipment may be stored by Deck The House Lighting under a separate storage arrangement.

Future seasonal installations, maintenance, removal, and storage are not included unless expressly stated in writing.

3. Pricing and Payment Terms

All pricing is provided through a customized proposal based on the property's layout, design requirements, equipment, and labor.

A 50% deposit is required upon acceptance of the proposal to reserve installation capacity.

The remaining 50% balance is due upon completion of the initial installation unless otherwise specified in writing.

Additional charges may apply for customer-requested design modifications, additional materials, or services outside the approved scope. Such charges require customer approval.

Payments not received by their agreed due dates may result in delayed services or other remedies permitted by applicable law and the agreement.

4. Cancellations and Rescheduling

Customers are requested to provide at least 72 hours' notice before a scheduled installation if cancellation or rescheduling is necessary.

Deposits may be applied toward reasonable costs already incurred, including special-order materials, project preparation, and reserved installation capacity, subject to applicable law.

Any refund eligibility will depend on the circumstances of cancellation and applicable legal requirements.

If Deck The House Lighting cannot reasonably fulfill the contracted services, customers will be offered an alternative installation date or an appropriate refund for services not provided.

5. Installation Scheduling and Weather

Installation dates are scheduled based on crew availability, weather conditions, property access, and project requirements.

Deck The House Lighting reserves the right to postpone or suspend work when conditions are unsafe, including severe weather, lightning, high winds, ice, or hazardous roof conditions.

Installation dates and completion estimates are not guaranteed when affected by circumstances outside the company's reasonable control.

Customers will be notified of material scheduling changes as soon as reasonably practicable.

6. Property Access and Electrical Requirements

Customers agree to provide safe and reasonable access to the areas necessary for installation, maintenance, and removal.

Customers are responsible for providing suitable, functional electrical outlets and obtaining any necessary HOA or property management approvals.

Known electrical problems, damaged gutters, deteriorated roofing, structural defects, and other relevant hazards must be disclosed before installation.

Deck The House Lighting may decline work or request corrective action when property conditions present an unreasonable safety risk.

7. Installation and Property Care

Deck The House Lighting uses professional installation practices and takes reasonable precautions to protect customer property.

Installations may involve clips, temporary fasteners, and other approved mounting methods.

Permanent alterations or penetrations to building surfaces require customer authorization.

The company is not responsible for pre-existing property damage or deterioration unrelated to its services.

Deck The House Lighting remains responsible for damage directly resulting from its negligence or misconduct to the extent required by applicable law.

8. In-Season Maintenance

Routine in-season maintenance is included during the contracted service period unless otherwise specified in the proposal.

Covered maintenance generally includes:

  • Replacement of failed company-supplied bulbs

  • Correction of ordinary lighting malfunctions

  • Adjustment of loose or displaced decorations under normal conditions

  • Repairs attributable to installation workmanship

Damage caused by vandalism, theft, animals, customer interference, misuse, or extraordinary weather events may require additional charges.

For customer-owned equipment, replacement materials are subject to applicable product warranties and the customer's selected maintenance coverage.

Deck The House Lighting will respond to service requests within a reasonable timeframe based on weather, safety, crew availability, and the nature of the issue.

9. Product Warranties

Commercial-grade products sold to customers may carry manufacturer warranties, as identified in the proposal or accompanying product documentation.

Deck The House Lighting does not guarantee that all purchased products carry the same warranty period or coverage.

Manufacturer warranty coverage does not automatically include labor, removal, reinstallation, transportation, or replacement of products damaged by misuse, external events, or normal wear.

Any additional workmanship warranty provided by Deck The House Lighting will be specified in writing.

10. Removal and Storage

Seasonal removal will be scheduled within the removal period identified in the customer's agreement, subject to weather and operational conditions.

Leased equipment: All materials will be removed and retained by Deck The House Lighting.

Customer-owned equipment: Materials will be returned to the customer or stored by Deck The House Lighting according to the accepted proposal.

Customer-owned equipment accepted for storage will be handled with reasonable care.

Storage arrangements, fees, access, retrieval, and liability for loss or damage will be governed by the applicable customer agreement.

Customers agree to provide reasonable access for scheduled removal.

11. Equipment Damage and Unauthorized Modifications

Customers agree not to alter, relocate, disconnect, or modify installed equipment without authorization, except when reasonably necessary to address an immediate safety concern.

Customers may be responsible for reasonable repair or replacement costs for company-owned equipment lost or damaged through their negligence, intentional acts, or unauthorized modifications.

Damage caused by ordinary equipment failure or Deck The House Lighting's negligence will not be charged to the customer.

12. Renewal and Future Seasons

Holiday lighting services are contracted on a seasonal basis unless a separate written agreement provides otherwise.

Services do not automatically renew.

Future installation dates, service pricing, and product availability are subject to a new proposal or renewal agreement.

Customer ownership of lighting materials does not guarantee future installation pricing or availability.

13. Privacy and Customer Information

Deck The House Lighting collects customer contact information, service addresses, and project details to prepare proposals, coordinate scheduling, process payments, and deliver services.

Customer information is not sold to third parties.

Information may be shared with payment processors and other service providers as reasonably necessary to fulfill the agreement or comply with legal obligations.

Marketing communications, where applicable, will be handled in accordance with applicable law and customer preferences.

14. Limitation of Liability

Deck The House Lighting will exercise reasonable care in providing its services.

To the extent permitted by applicable law, the company is not responsible for indirect or consequential damages arising from events outside its reasonable control.

Nothing in these Terms of Service limits liability that cannot lawfully be limited or excludes responsibility for negligence or misconduct where such an exclusion is prohibited.

15. Governing Law

These Terms of Service are governed by the laws of the State of Georgia.

16. Changes to Terms

Deck The House Lighting may update these Terms of Service periodically.

Revised terms will apply to future agreements after their effective date. Existing agreements will remain subject to their accepted terms unless amended by mutual agreement.

17. Customer Acknowledgment

By accepting a proposal and expressly agreeing to these Terms of Service, the customer confirms that they understand the selected lighting ownership option, service scope, payment obligations, and applicable conditions.
